1 About Fix PDF

Fix PDF is a PDF utility platform that provides tools for converting, compressing, merging, splitting, editing, watermarking, password-protecting, signing, performing OCR, and otherwise manipulating PDF and document files. The Service is available via our website and mobile applications for iOS and Android.

2 Eligibility and Account Registration

2.1 Eligibility

To use Fix PDF, you must:

• Be at least 13 years of age (or 16 years of age in certain EU member states where a higher minimum age applies for digital services)
• Have the legal capacity to enter into a binding contract in your jurisdiction
• Not be prohibited from using the Service under the laws of your country or any other applicable jurisdiction
• Not have had a previous Fix PDF account terminated for violation of these Terms

By using the Service, you represent and warrant that you meet all eligibility requirements above.

2.2 Account Registration

Creating an account on Fix PDF is optional. You may use many features as a guest. If you choose to register:

• You agree to provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
• You agree to notify us immediately at support@fixpdf.ai if you suspect unauthorized access to your account.
• You may not create more than one personal account, share your account with others, or use another person's account without their permission.
• Fix PDF reserves the right to refuse registration or suspend accounts at its discretion.

2.3 Account Security

You are solely responsible for all activity that occurs through your account, whether or not you authorized it. Fix PDF will not be liable for any loss resulting from unauthorized use of your account. We recommend using a strong, unique password and enabling any available security features.

3 Description of the Service

3.1 Core Features

Fix PDF provides the following categories of PDF tools (subject to change and expansion over time):

• Conversion: Convert PDF files to and from formats including Word, Excel, PowerPoint, images, HTML, and more
• Compression: Reduce PDF file size while maintaining acceptable quality
• Organization: Merge multiple PDFs into one, split PDFs into separate files, reorder, rotate, or delete pages
• Editing: Add or edit text, images, annotations, headers, footers, and page numbers
• Security: Encrypt PDFs with passwords, remove passwords, add or remove restrictions
• Watermarking: Add text or image watermarks to PDF documents
• Signing: Electronically sign PDF documents
• OCR: Optical Character Recognition to make scanned documents searchable and editable
• Other utilities: Additional PDF-related tools as made available from time to time

3.2 Free and Premium Services

Fix PDF offers both free and premium tiers. The free tier is supported by advertising. Premium tiers may offer additional features, higher file size limits, faster processing, and an ad-free experience. Specific features available in each tier are described on our pricing page and may be updated at any time.

3.3 Service Availability

Fix PDF aims to provide continuous and uninterrupted access to the Service, but does not guarantee 100% uptime. We may perform scheduled maintenance, emergency maintenance, or updates that temporarily interrupt availability. We will endeavor to give advance notice of significant planned downtime where practicable.

3.4 Third-Party Processing

Certain features of Fix PDF are powered by third-party processing APIs. By using these features, you acknowledge that your uploaded files will be transmitted to third-party servers for processing. We select providers that maintain reasonable security and data protection standards. Your files are processed solely for the purpose of fulfilling your requested operation and are deleted promptly upon completion.

4 Acceptable Use Policy

4.1 Permitted Use

You may use Fix PDF solely for lawful purposes and in accordance with these Terms. You agree to use the Service only to process files that you own, have created, or have explicit permission to process.

4.2 Prohibited Conduct

You agree that you will NOT use Fix PDF to:

• Upload, process, transmit, or distribute any content that is unlawful, infringing, defamatory, obscene, pornographic, or otherwise objectionable
• Process files containing malware, viruses, Trojan horses, worms, or any other malicious or harmful code
• Infringe upon or violate the intellectual property rights, privacy rights, or any other rights of any third party
• Upload confidential or proprietary documents belonging to others without their authorization
• Attempt to gain unauthorized access to Fix PDF systems, networks, servers, or other users' accounts
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of Fix PDF or any of its components
• Use automated tools, bots, scripts, or crawlers to access, scrape, or interact with the Service in a manner that places excessive load on our infrastructure
• Circumvent any access controls, rate limits, file size restrictions, or other technical measures
• Use the Service to engage in any commercial activity that competes directly with Fix PDF without our prior written consent
• Impersonate any person or entity, or falsely represent your affiliation with any person or entity
• Violate any applicable local, national, or international law or regulation
• Use the Service in any way that could damage, disable, impair, or compromise Fix PDF's systems or security

4.3 Content Responsibility

You are solely responsible for all files and content you upload to or process through Fix PDF. Fix PDF does not review, moderate, or take responsibility for user-uploaded content. However, we reserve the right to remove any content and suspend any account that we believe, in our sole discretion, violates these Terms or applicable law.

4.4 Reporting Violations

If you become aware of any violation of these Terms or any unlawful activity on Fix PDF, please report it to us at support@fixpdf.ai. We take all reports seriously and will investigate appropriately.

5 Intellectual Property

5.1 Fix PDF's Intellectual Property

All content, features, and functionality of the Fix PDF platform — including but not limited to the software, design, user interface, graphics, logos, icons, text, and underlying technology — are owned by Fix PDF or its licensors and are protected by applicable intellectual property laws including copyright, trademark, and patent laws.

Nothing in these Terms grants you any right, title, or interest in or to Fix PDF's intellectual property. You may not copy, modify, distribute, sell, sublicense, or create derivative works from any part of the Service without our prior written consent.

5.2 Your Content

You retain full ownership of all files and documents you upload to Fix PDF. By uploading files to the Service, you grant Fix PDF a limited, non-exclusive, royalty-free, worldwide license to process, store (temporarily), and transmit your files solely for the purpose of providing the requested Service to you. This license terminates when your files are deleted from our systems.

Fix PDF does not claim any ownership over your files, does not sell your files to third parties, and does not use the content of your files for any purpose beyond processing your requests.

5.3 Feedback

If you provide Fix PDF with any feedback, suggestions, ideas, or improvement requests regarding the Service ("Feedback"), you grant Fix PDF a perpetual, irrevocable, royalty-free, worldwide license to use, incorporate, and commercialize such Feedback without any obligation to compensate you or acknowledge your contribution.

5.4 Copyright Infringement / DMCA

Fix PDF respects the intellectual property rights of others. If you believe that content processed or made available through our Service infringes your copyright, please send a notice to support@fixpdf.ai including: (a) identification of the copyrighted work; (b) identification of the allegedly infringing material; (c) your contact information; (d) a statement that you have a good faith belief the use is unauthorized; and (e) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

6 Advertising

Fix PDF's free tier is supported by third-party advertising. By using the free tier of Fix PDF, you acknowledge and agree that:

• Advertisements may be displayed within the Service, including on web pages and within the mobile application.
• Third-party advertisers and advertising networks may collect data about your interactions with the Service to serve relevant ads, subject to your consent preferences and applicable law.
• Fix PDF does not endorse or take responsibility for the content of third-party advertisements.
• You agree not to use ad-blocking software or browser extensions in a manner that interferes with Fix PDF's ability to display advertisements as part of the free service.

7 Payments, Subscriptions, and Refunds

7.1 Premium Plans

Fix PDF may offer paid premium subscription plans providing enhanced features. All prices are listed on our pricing page and are subject to change with reasonable notice to existing subscribers.

7.2 Billing

Premium subscriptions are billed on a recurring basis (monthly or annually, as selected). By subscribing, you authorize Fix PDF or its payment processor to charge your chosen payment method on a recurring basis. All payments are processed by third-party payment processors; Fix PDF does not store your payment card details.

7.3 Taxes

All prices displayed are exclusive of applicable taxes (including GST in India) unless stated otherwise. You are responsible for all applicable taxes associated with your purchase.

7.4 Cancellation

You may cancel your subscription at any time through your account settings or by contacting support@fixpdf.ai. Upon cancellation, your premium access will continue until the end of your current billing period, after which your account will revert to the free tier. Fix PDF does not provide prorated refunds for unused portions of a subscription period.

7.5 Refunds

All purchases are generally non-refundable except where required by applicable law. If you believe you are entitled to a refund due to a technical error, duplicate charge, or other exceptional circumstance, please contact us at support@fixpdf.ai within 7 days of the charge. We will review each request on a case-by-case basis.

7.6 Free Trials

If Fix PDF offers a free trial of a premium plan, the trial period and terms will be clearly stated at sign-up. Unless you cancel before the end of the trial period, your chosen payment method will be automatically charged at the applicable subscription rate at the conclusion of the trial.

8 Privacy

Your privacy is extremely important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Fix PDF, you agree to the terms of our Privacy Policy.

The Privacy Policy explains: what information we collect, how we use it, how we share it with third parties (including advertising partners and PDF processing APIs), how long we retain it, and what rights you have over your data.

9 Disclaimers and Warranties

9.1 No Guarantee of Results

Fix PDF does not warrant that: (a) the Service will meet your specific requirements; (b) the Service will be uninterrupted, timely, secure, or error-free; (c) the results obtained from using the Service will be accurate or reliable; or (d) any errors in the Service will be corrected.

9.2 File Processing

While Fix PDF strives to accurately process your files, we do not guarantee that converted, compressed, merged, or otherwise processed files will be free from formatting errors, data loss, or corruption. You are strongly advised to maintain backup copies of all original files before using any Fix PDF tool.

9.3 Third-Party Services

Fix PDF is not responsible for the performance, availability, security, or accuracy of any third-party services, APIs, or platforms used to power the Service. Any reliance on such third-party services is at your own risk.

9.4 Accuracy of Outputs

OCR, translation, and other AI-assisted features may produce outputs that contain errors, omissions, or inaccuracies. Such outputs should be reviewed and verified before use in any professional, legal, medical, or other critical context. Fix PDF accepts no liability for decisions made based on inaccurate outputs.

10 Limitation of Liability

In jurisdictions that do not allow the exclusion of certain warranties or limitations of liability, our liability is limited to the maximum extent permitted by law.

10.1 Cap on Liability

To the extent Fix PDF has any liability to you notwithstanding the above, our total aggregate liability to you for all claims arising out of or relating to the Service or these Terms shall not exceed the greater of: (a) the total amount you have paid to Fix PDF in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) INR 500 (Five Hundred Indian Rupees) if you have not made any payments.

10.2 Essential Basis

The disclaimers and limitations of liability in these Terms reflect a reasonable and fair allocation of risk between you and Fix PDF, and form an essential basis of the bargain between you and Fix PDF. Fix PDF would not be able to provide the Service on an economically viable basis without these limitations.

11 Indemnification

You agree to indemnify, defend, and hold harmless Fix PDF and its officers, directors, employees, contractors, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to:

• Your violation of these Terms
• Your use or misuse of the Service
• Any content or files you upload, process, or transmit through the Service
• Your violation of any third party's rights, including intellectual property rights or privacy rights
• Your violation of any applicable law or regulation

Fix PDF reserves the right to assume exclusive control of the defense of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims.

12 Termination and Suspension

12.1 Termination by You

You may stop using the Service and close your account at any time by contacting us at support@fixpdf.ai or through your account settings. Upon account deletion, your data will be handled in accordance with our Privacy Policy.

12.2 Termination by Fix PDF

Fix PDF reserves the right to suspend or terminate your access to the Service, with or without notice, for any reason including but not limited to:

• Violation of these Terms or our Acceptable Use Policy
• Conduct that we determine, in our sole discretion, is harmful to other users, Fix PDF, or third parties
• Extended periods of account inactivity
• Requests from law enforcement or government authorities
• Unforeseen technical or security issues

12.3 Effect of Termination

Upon termination: (a) your right to access and use the Service immediately ceases; (b) we may delete your account data and uploaded files in accordance with our Privacy Policy; (c) provisions of these Terms that by their nature should survive termination shall survive, including Sections 5 (Intellectual Property), 9 (Disclaimers), 10 (Limitation of Liability), 11 (Indemnification), and 15 (Governing Law).

13 Modifications to the Service and Terms

13.1 Changes to the Service

Fix PDF reserves the right to modify, update, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify users of significant changes that may affect their use of the Service. Fix PDF shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

13.2 Changes to These Terms

We may revise these Terms from time to time. When we make material changes, we will:

• Update the 'Last Updated' date at the top of this document
• Notify registered users via email or an in-app notification at least 14 days before the changes take effect
• For material changes that significantly affect your rights, seek fresh consent where required by law

Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of those changes. If you do not agree with the revised Terms, you must stop using the Service.

14 Third-Party Links and Services

The Service may contain links to third-party websites, services, or resources. These links are provided for your convenience only. Fix PDF does not endorse, control, or take responsibility for the content, privacy practices, or terms of any third-party sites or services. Your interaction with third-party sites is at your own risk and subject to their respective terms and policies.

Fix PDF is not responsible for the availability, accuracy, or reliability of any third-party content or services, or for any harm or damages arising from your use of or reliance on them.

15 Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. The Information Technology Act, 2000 (as amended) and other applicable Indian laws shall apply.

15.2 Jurisdiction

Subject to the arbitration provisions below, you agree that any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the courts of competent jurisdiction in Surat, Gujarat, India, and you hereby consent to the personal jurisdiction of such courts.

15.3 Informal Resolution

Before initiating any formal dispute, you agree to first contact Fix PDF at support@fixpdf.ai and attempt to resolve the dispute informally. We will try to resolve the dispute within 30 days of receiving your notice. If resolution cannot be reached informally, either party may proceed to formal dispute resolution as described below.

15.4 Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service that cannot be resolved informally shall be resolved by binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 of India. The arbitration shall be conducted in English, seated in Surat, Gujarat, India. The decision of the arbitrator shall be final and binding on both parties.

15.5 Class Action Waiver

To the extent permitted by applicable law, you agree that any dispute resolution proceeding will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

15.6 EU/UK Users

If you are located in the EU or UK, nothing in these Terms affects your rights to bring a claim before the courts of your country of residence or to benefit from any mandatory consumer protection provisions that apply in your jurisdiction. EU consumers may also use the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr.

16 General Provisions

16.1 Entire Agreement

These Terms, together with the Privacy Policy and any other policies or guidelines incorporated by reference, constitute the entire agreement between you and Fix PDF regarding the Service and supersede all prior agreements, communications, and understandings.

16.2 Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall continue in full force and effect.

16.3 Waiver

Fix PDF's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of Fix PDF to be effective.

16.4 Assignment

You may not assign or transfer these Terms, or any rights or obligations hereunder, without Fix PDF's prior written consent. Fix PDF may freely assign these Terms in connection with a merger, acquisition, or sale of assets. Any attempted assignment in violation of this section is null and void.

16.5 Force Majeure

Fix PDF shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, government actions, internet or telecommunications failures, or other circumstances beyond our control.

16.6 No Agency

Nothing in these Terms creates any agency, partnership, joint venture, employment, or franchise relationship between you and Fix PDF. You have no authority to bind Fix PDF to any obligation.

16.7 Language

These Terms are drafted in English. If these Terms are translated into another language, the English version shall govern in the event of any conflict or inconsistency.
